Terms of Service

These Terms of Service ("Terms") form a legally binding agreement between you and Mahmoud Mehrjoo ("Marsoole", "we", "our", "us") and govern your access to and use of the Marsoole mobile application and any related services (collectively, the "Service").

Marsoole is a community classifieds and peer-to-peer service designed primarily for members of the Persian-speaking (Farsi) diaspora. By creating an account, signing in, or otherwise using the Service, you agree to these Terms, our Privacy Policy, and our Community Guidelines.

These Terms include important provisions — sanctions and export-control representations, a class-action waiver, mandatory arbitration, and limitations on our liability. If you do not agree, do not use the Service.

1. Eligibility & account

You must be at least 13 years old (and the age of digital consent in your jurisdiction) to use the Service. By creating an account you represent that you meet this requirement and have the legal capacity to enter into a contract.

Keep your sign-in credentials secret. You are responsible for everything that happens under your account, including content you post, messages you send, and transactions you arrange with other users. One person — one account. You may not transfer or share your account.

2. What Marsoole is — and is not

Marsoole is a platform that connects Persian-speaking diaspora users who want to share information and arrange peer-to-peer transactions across five surfaces: Hamkar (job postings), Hamkhooneh (rooms and roommates), Marsoole/Hamsafar (peer-to-peer parcel delivery via travelers), Bazar (buying and selling among users), and Anjoman (community Q&A).

Marsoole is NOT a party to any transaction between users. We are not a courier, freight forwarder, customs broker, employer, recruiter, staffing agency, landlord, real-estate broker, escrow agent, financial institution, payment processor, or merchant of record.

All transactions — for money, goods, services, leases, employment, travel, or anything else — are arranged directly between users, on their own terms, at their own risk. Marsoole does not take a commission, hold funds in escrow, guarantee performance, or insure any transaction.

3. Sanctions, export controls, and embargoes

Marsoole is intended primarily for members of the Persian-speaking diaspora residing OUTSIDE Iran. The Service itself is a means of personal communication and information exchange, consistent with U.S. Office of Foreign Assets Control ("OFAC") General License D-2 issued under the Iranian Transactions and Sanctions Regulations (31 C.F.R. Part 560), and with comparable general authorizations under European Union, United Kingdom, and Canadian sanctions regimes.

By using the Service, you represent and warrant that:

  • You are not identified on the U.S. OFAC Specially Designated Nationals and Blocked Persons List ("SDN List"), the U.S. Department of Commerce Entity List or Denied Persons List, the EU Consolidated List of Persons Subject to Restrictive Measures, the UK Office of Financial Sanctions Implementation Consolidated List, the UN Security Council Consolidated Sanctions List, or any equivalent restricted-party list (collectively, "Restricted Party Lists").
  • You are not acting at the direction of, or on behalf of, any person or entity on any Restricted Party List.
  • You will not use the Service to (a) export, re-export, or transfer goods, technology, software, or services to any sanctioned country, region, person, or entity in a manner that requires a license you do not hold; (b) facilitate any transaction prohibited by U.S., EU, UK, UN, or other applicable sanctions or export-control laws; (c) violate the U.S. Export Administration Regulations ("EAR") or the International Traffic in Arms Regulations ("ITAR"); or (d) circumvent any embargo, export control, or trade restriction.
  • You will not use the Service in a manner that would cause Marsoole to violate any sanctions or export-control law.
  • If you become a Restricted Party, are sanctioned, or relocate to a comprehensively sanctioned region for the purpose of conducting commercial transactions, you will immediately stop using the Service and delete your account.

Note on Iran-related personal use of the Marsoole/Hamsafar parcel feature: OFAC General License D-2 and certain personal-effects exemptions (e.g., 31 C.F.R. § 560.534 and § 560.524) may permit limited noncommercial transactions between U.S. persons and family members in Iran, including the sending of gifts of modest value. These authorizations are conditional, subject to change, and do not extend to commercial transactions, items on prohibited lists, items intended for resale, or transactions with persons or entities on Restricted Party Lists. Marsoole does not provide legal advice on the scope of these authorizations. You are solely responsible for determining whether any package you send or carry complies with all applicable sanctions, export controls, customs laws, and other regulations, and for obtaining any required license. When in doubt, do not send.

4. Prohibited content and items

You may not post, send, request, accept, carry, sell, buy, or otherwise distribute through the Service any of the following:

  • Anything illegal in the sender's jurisdiction, the recipient's jurisdiction, or any jurisdiction the item passes through.
  • Anything that violates U.S., EU, UK, UN, or other applicable sanctions or export-control laws, including items subject to the EAR, ITAR, or comparable regimes.
  • Illegal drugs, narcotics, controlled substances, precursor chemicals, or drug paraphernalia.
  • Weapons, ammunition, explosives, firearms (including replicas, components, parts, magazines, optics, and accessories), tasers, body armor (where restricted), or any item whose principal purpose is to inflict bodily harm.
  • Dual-use technology, cryptographic items beyond mass-market consumer goods, surveillance equipment, drones (where restricted), or items requiring an export license you do not hold.
  • Counterfeit, replica, pirated, or trademark-infringing goods.
  • Hazardous, flammable, corrosive, poisonous, radioactive, or biohazardous materials.
  • Live animals, plants, seeds, soil, perishable food, raw meat, dairy, alcohol (where restricted), tobacco (where restricted), e-cigarettes, or vape products.
  • Human remains, body parts, body fluids, or medical specimens.
  • Prescription medications, over-the-counter medications in regulated quantities, supplements making medical claims, medical devices, or vaccines.
  • Stolen goods or goods of questionable provenance.
  • Currency, monetary instruments, traveler's checks, prepaid cards, gift cards, or other negotiable items above customs declaration thresholds.
  • Cryptocurrency wallets, hardware crypto-wallets, mining hardware, or any item intended to facilitate sanctions evasion.
  • Cultural property, antiquities, archaeological artifacts, or items whose export is restricted by their country of origin.
  • Adult content, sexually explicit material, escort services, or any sexual services.
  • Hate speech, threats, content promoting violence, harassment, or discrimination against any individual or group on the basis of race, ethnicity, national origin, religion, gender, sexual orientation, disability, or other protected characteristic.
  • Content that is false or misleading in a way intended to defraud or deceive.
  • Content that infringes intellectual property, defames a person, or violates someone's privacy.
  • Content that exploits, sexualizes, endangers, or solicits minors in any way. We have ZERO tolerance for child sexual abuse material (CSAM), grooming, or any content sexualizing minors. We report such material to the U.S. National Center for Missing and Exploited Children (NCMEC) and cooperate with law enforcement.
  • Spam, bulk advertising, chain messages, pyramid schemes, multi-level marketing recruitment, or any unsolicited commercial communication.
  • Anything Marsoole, in its sole discretion, determines is unsafe, unlawful, or contrary to the spirit of the community.

5. User conduct

When using the Service, you will not:

  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Post or transmit content that is unlawful, threatening, abusive, harassing, defamatory, libelous, obscene, vulgar, sexually explicit, hateful, racially or ethnically offensive, or otherwise objectionable.
  • Harass, stalk, threaten, or intimidate other users on or off the Service.
  • Engage in any form of fraud, scam, phishing, identity theft, or financial deception.
  • Solicit personal or financial information from other users.
  • Solicit, attempt to meet, or send sexual material to minors.
  • Interfere with, disrupt, or attempt to gain unauthorized access to the Service, our servers, or any systems we use.
  • Use bots, scrapers, crawlers, or any automated means to access, copy, or extract content or data from the Service.
  • Reverse-engineer, decompile, or attempt to derive source code from the Service, except to the extent expressly permitted by applicable law.
  • Use the Service to send unsolicited commercial messages.
  • Circumvent any technical or content-policy measure we apply.
  • Use the Service for any purpose other than the one we intend.

6. Parcel delivery via travelers (Marsoole / Hamsafar) — additional terms

The Marsoole/Hamsafar feature connects independent travelers who are willing to carry packages with senders who need items moved between cities or countries. This feature carries unique legal, customs, and personal-safety risks. Please read this section carefully. By using this feature you accept everything in it.

  • Marsoole is NOT a courier, freight forwarder, customs broker, postal operator, indirect air carrier, ocean transportation intermediary, or licensed transportation provider of any kind. Travelers who agree to carry packages are independent users acting in their personal capacity, not Marsoole employees, contractors, or agents.
  • You bear sole responsibility for the lawful transport of any package you send, accept, or carry. If you would not declare the contents honestly to customs, or if you are not certain the contents are lawful in every jurisdiction the package passes through, do not send and do not carry it.
  • Senders MUST: declare contents truthfully, in writing, to the traveler before handoff; ensure the contents do not violate Section 4 (Prohibited content and items) or Section 3 (Sanctions); provide accurate contact information for both ends; meet the traveler in a safe public place; and personally hand over the package (no third-party drop-offs).
  • Travelers MUST: inspect every package they accept and refuse any package whose contents they cannot personally verify or whose contents they reasonably suspect are mislabeled, contraband, restricted, or unsafe; refuse any package that is sealed in a way that prevents inspection; refuse any package whose declared value or contents do not match what they observe.
  • Either party may refuse or cancel a request at any time, for any reason, including up to the moment of physical handoff.
  • Marsoole does NOT inspect, weigh, scan, verify, insure, or vouch for any package, photo, description, or user.
  • All duties, taxes, fees, fines, customs penalties, detentions, seizures, civil claims, and criminal consequences arising from a package are the sole responsibility of the sender and the traveler involved. Marsoole has no obligation to advance, indemnify, or otherwise cover any such cost.
  • Loss, damage, theft, seizure, delay, or non-delivery is at the parties' own risk. Marsoole does not insure packages. Senders are encouraged to consider third-party insurance for items of value.
  • Any payment or compensation between sender and traveler is a private matter between them. Marsoole does not process payments, hold escrow, guarantee payment, arbitrate disputes, or refund money.
  • If you suspect a transaction involves illegal activity — including but not limited to sanctions evasion, narcotics, weapons, money laundering, or human trafficking — refuse it, report it to local law enforcement and the appropriate authorities (in the U.S., the OFAC hotline at 1-800-540-6322 for sanctions concerns), and report it to us at safety@marsoole.me.

7. Other modules — additional terms

Hamkhooneh (rooms / roommates). Marsoole is not a landlord, property manager, tenant-screening service, real-estate broker, or party to any rental, sublease, or roommate agreement. We do not perform background checks, credit checks, or income verification. Always verify the identity of the other party, view the property in person, and use a written agreement.

Hamkar (jobs). Marsoole is not an employer, recruiter, staffing agency, payroll provider, or party to any employment relationship. We do not vet employers, candidates, wages, working conditions, immigration status, or work authorization. Comply with applicable employment, wage, anti-discrimination, and immigration laws.

Bazar (marketplace). Marsoole does not sell, ship, deliver, store, insure, or guarantee any item listed. Buyers and sellers are responsible for the legality, accuracy, quality, payment, transfer of title, taxes, and safety of their own dealings.

Anjoman (community Q&A). Replies are user opinions, not professional advice. Do not rely on Anjoman for medical, legal, immigration, tax, financial, or other professional advice. Consult a qualified professional.

Direct messaging. Conversations between users are not monitored in real time. However, we may review messages in response to reports, suspected violations of these Terms, threats to safety, or as required by law.

8. Content moderation, reporting, and blocking

Marsoole has zero tolerance for objectionable content and abusive behavior. We provide tools so the community can keep itself healthy:

  • Reporting. Every listing, message, reply, and user profile can be reported from inside the app. Reports of safety issues can also be sent to safety@marsoole.me. We commit to reviewing reports within 24 hours and acting on them as appropriate.
  • Blocking. You can block any other user from inside the app. A blocked user can no longer message you, see new content you post, or interact with you in Anjoman.
  • Removal. We may, in our sole discretion and without notice, remove content; lock or suspend accounts; permanently ban users; preserve and disclose records to law enforcement; or take any other action we believe is necessary to protect the community, comply with the law, or enforce these Terms.
  • Filtering. We use automated and human review to filter content that violates these Terms. No filter is perfect; we depend on user reports to catch what slips through.
  • Appeals. If you believe a moderation action was taken in error, email appeals@marsoole.me with the affected listing/user URL and your reason. We will review and respond within a reasonable time.

9. Your content and license

You retain ownership of the content you post (listings, photos, messages, replies, profile information).

You grant Marsoole a worldwide, royalty-free, non-exclusive, sublicensable, transferable license to host, store, reproduce, display, distribute, modify (for purposes such as resizing, cropping, format conversion, and translation), and otherwise use your content as necessary to operate, improve, and promote the Service. This license ends when you delete the content, subject to copies that may persist for legal, backup, or operational reasons.

You represent that you own or have all necessary rights to the content you post, and that the content does not infringe any third party's intellectual property, privacy, publicity, or other right, and does not violate any law.

If you believe content on the Service infringes your copyright, send a DMCA notice to dmca@marsoole.me with the information required by 17 U.S.C. § 512.

10. Termination

You may delete your account at any time from Settings → Account → Delete account. Deletion removes your profile, listings, push tokens, saved items, and other personal data; some content (e.g., conversations involving other users, audit records, content needed for legal compliance) may persist on our systems.

We may suspend or terminate your account for any breach of these Terms, our Community Guidelines, or applicable law, or for any reason that we believe is necessary to protect the community or Marsoole. Termination does not relieve you of obligations that by their nature survive (sections 3, 4, 6, 9, 12, 13, 14, 15).

11. Disclaimer of warranties

THE SERVICE AND ALL CONTENT IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES.

WE MAKE NO REPRESENTATION OR WARRANTY REGARDING THE CONDUCT, IDENTITY, AGE, BACKGROUND, INTENT, OR REPRESENTATIONS OF ANY USER; THE ACCURACY OR COMPLETENESS OF ANY LISTING; THE SAFETY OF ANY MEETING; THE LEGALITY, SAFETY, OR CONTENTS OF ANY PACKAGE TRANSPORTED THROUGH THE SERVICE; OR THE OUTCOME OF ANY TRANSACTION ARRANGED THROUGH THE SERVICE.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MARSOOLE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, REPUTATION, OR OTHER INTANGIBLE LOSS, ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF (OR INABILITY TO USE) THE SERVICE, WHETHER IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF MARSOOLE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MARSOOLE'S TOTAL CUMULATIVE LIABILITY ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID TO MARSOOLE IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

13. Indemnification

You agree to defend, indemnify, and hold harmless Marsoole and its officers, directors, employees, and agents from and against any and all claims, demands, actions, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising from or relating to (a) your access to or use of the Service; (b) any content you post or transmit; (c) your interactions with any other user, including any package you send or carry through the Hamsafar feature; (d) your violation of these Terms, our Community Guidelines, or any applicable law; (e) your violation of any third party's right, including intellectual property, privacy, or publicity rights; or (f) any tax, duty, fine, or penalty imposed in connection with a transaction arranged through the Service.

14. Governing law, arbitration, and class-action waiver

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service (a "Dispute") will be resolved exclusively through final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, with the arbitration seated in Dallas, Texas. Judgment on the award may be entered in any court of competent jurisdiction. Either party may seek interim injunctive relief in court to protect intellectual property or confidential information.

YOU AND MARSOOLE WAIVE ANY RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. Disputes will be resolved on an individual basis only.

You may opt out of the arbitration agreement by emailing legal@marsoole.me within 30 days of your first acceptance of these Terms, stating your name, account email, and that you opt out of arbitration. Opting out does not affect any other part of these Terms.

15. Apple-specific terms (iOS users)

If you use the Service on an Apple device, the following additional terms apply. You acknowledge that:

  • These Terms are concluded between you and Marsoole only, and not with Apple Inc. or any of its subsidiaries ("Apple"). Marsoole — not Apple — is solely responsible for the Service and its content.
  • The license granted to you for the Service is a non-transferable license to use the Service on any Apple-branded products that you own or control, subject to the Usage Rules set forth in the Apple Media Services Terms and Conditions.
  • Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the Service.
  • In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Service to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Service. Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are Marsoole's sole responsibility.
  • Marsoole, not Apple, is responsible for addressing any claims by you or any third party relating to the Service or your possession and use of the Service, including (i) product liability claims; (ii) any claim that the Service fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
  • In the event of any third-party claim that the Service or your possession and use of the Service infringes that third party's intellectual property rights, Marsoole — not Apple — is solely responsible for the investigation, defense, settlement, and discharge of any such claim.
  • You represent and warrant that (i) you are not located in a country subject to a U.S. government embargo, or that has been designated by the U.S. government as a "terrorist supporting" country, and (ii) you are not listed on any U.S. government list of prohibited or restricted parties.
  • You must comply with applicable third-party agreement terms (for example, your wireless data services agreement) when using the Service.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple has the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

16. Privacy

Our Privacy Policy describes what information we collect, how we use it, and the choices you have. The Privacy Policy is incorporated into these Terms by reference. By using the Service, you also agree to the Privacy Policy.

17. Modifications to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you in the app and update the effective date above. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree with the updates, stop using the Service and delete your account.

18. Miscellaneous

These Terms are the entire agreement between you and Marsoole regarding the Service and supersede any prior agreements. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms; we may. Notices to you may be delivered in the app, by email, or by other reasonable means.
